Guardianship and Conservatorship in Colorado: What You Need to Know

Guardianships and conservatorships are legal proceedings used when an adult can no longer make or communicate safe or sound decisions about his/her person or assets. This individual may become susceptible to fraud or undue influence, leaving them vulnerable to scam artists or identity thieves. Guardianship provides protection and care for adults with dementia, mental illness, intellectual or developmental disabilities, or other mental impairments.

Colorado recognizes two types of fiduciaries to take care of people who are unable, because of disability or incapacity, to take care of themselves. A conservator takes care of property and finances and a guardian takes care of the person.

It is important that you select who you trust to serve as your conservator or guardian. Unless you make a proper designation, the courts could appoint someone you do not know to take care of you and your property. It is not enough for a doctor to recommend a family member or other interested person to take on this responsibility; the court must establish the role of Guardian.
