Potomac Street, Centennial, CO 80112, and he is happy to share his knowledge and experience with you. His advanced tax degree allows him to evaluate your assets and goals with the expertise of a tax planner. He uses his experience to evaluate all estates, big or small.

What is an Estate Plan and why do I need one?

An estate plan is a tool to help you plan for unexpected or inevitable events in life. You probably have some form of insurance to protect you or your family from the effects of unplanned situations. Estate planning does something similar, but with words, to ensure your wishes are known and followed in case of an emergency. Simply put, your estate plan is your voice, expressing your wishes through a set of documents.

A thoughtful estate plan can help your family streamline probate or avoid probate altogether. The median household income in Greenwood Village is nearly $145,800, much higher than the statewide median of over $97,100. Families and married-couple families have a median income of between nearly $225,700 and $228,700. Oren “Von” Limbaugh can guide your planning to protect these assets for your loved ones and preserve your estate.

When should I get an Estate Plan?

Creating an estate plan sooner rather than later is crucial. Unfortunately, unexpected emergencies can happen at any time, but an estate plan can protect you. If you are a homeowner, you need an estate plan to name a person who can manage your finances in an unforeseen emergency where you are unable to handle them yourself. If you drive a car or ski, you need an estate plan to name a person to make medical decisions if you are in an accident and unable to do so yourself. An estate plan allows you to voice your wishes regarding medical and financial decisions, and the management and distribution of your assets.

Over 20% of the population in Greenwood Village is 65 years or older. While it is important to create an estate plan at any age, it is especially critical as you reach retirement age. Oren “Von” Limbaugh’s LLM in tax, gives him the expertise and experience to evaluate your assets. He understands the complexities of retirement planning and protecting your assets from Medicaid claw-backs.

What is a Greenwood Village Estate Plan?

Our estate plans are completely customizable, allowing you to include whatever documents support your financial and personal goals. Oren “Von” Limbaugh recommends everyone have these five basic documents:

  1. Medical Durable Power of Attorney (MPOA) – This document allows you to choose someone to make medical decisions for you. A durable MPOA comes into effect if you are incapacitated. Incapacitation can occur from illnesses or accidents.

If you don’t have an MPOA and you are incapacitated in a car accident, for example, the Court will choose someone for you who might not have the same values or beliefs you do. Establishing an MPOA lets you choose who is in control of these sensitive decisions.

  1. HIPAA Authorization – This lets you authorize specific individuals to receive healthcare information on your behalf. Without a HIPAA (Health Insurance Portability and Accountability Act) authorization, medical providers, insurance companies, and other healthcare entities generally cannot disclose this information to people other than you.
  1. Living Will (a/k/a Advanced Directives) – This document specifies what kind of treatment you want (or do not want) if you have a terminal condition, or if you need a life-sustaining procedure.
  1. General Durable Power of Attorney (GPOA) – This document allows you to choose someone to make financial decisions, like paying bills, opening and closing bank accounts, etc. A durable GPOA comes into effect if you are incapacitated. Incapacitation can occur from illnesses or accidents.

If you don’t have a GPOA and you are incapacitated in a car accident, for example, the Court will choose someone for you who might not have the same values or beliefs you do. Establishing a GPOA lets you choose who is in control of these sensitive decisions. You may make the same person or different people your MPOA and GPOA.

  1. Last Will and Testament – This document allows you to choose someone to oversee the distribution of your estate when you pass, and it lists the beneficiaries in that distribution. A will can also name guardians for minor children and mitigate certain tax consequences.

In 2020, one survey found that only 46% of U.S. adults had a will. Not having a will can make things more difficult for your family in an already difficult time. When a person dies intestate (without a will), the court decides how the person’s assets are distributed based on state laws. This is an impersonal process and does not consider the uniqueness of your family’s situation.

These five documents provide the planning and support most people need to manage their estates. You might benefit from the more comprehensive planning that a Trust document can provide.
